UN's Report on 2014 Gaza War Motivated Palestine

The threats of Palestine that it will open cases against Israel after it becomes ICC member, seems is becoming a reality. Today the Foreign Minister of Palestinian Authorities Riad Malki personally delivered files to the International Criminal Court about Israel’s war crimes in the Gaza Strip and settlement construction in the West Bank and East Jerusalem.

The file gives information on the actions of Israel, what it is doing and what reasonable grounds there are for starting an investigation. As The Guardian writes, it is the ICC chief prosecutor that would decide whether to start a preliminary examination and then a full criminal investigation.

The file, which is a 30-page one, is divided into 3 sections: illegal Israeli settlement activity; the treatment of Palestinian prisoners and 2014 Gaza war.

The filing, "confirms that the absence of accountability has led to the recurrence of violations and crimes and will continue to do so if gone unchecked," the Palestinians said, usnews.com reports.

This, of course, would make Israel crazy. Though there is no official reaction to this from the Israeli side, it is already known that Bensouda has asked Israel to provide some information about its actions, but this request has been rejected with the claim that Palestine is not a state and cannot make claims against Israel. As The Times of Israel informs, though Israel is not an ICC member, individuals accused by Palestine for war crimes can bring cases before Palestine.

Though Palestine was systematically declaring that it will file cases against Israel, it should be noted that it was the UN Human Rights Council’s report on 2014 Gaza war that "motivated" Palestine at last do it. This was an appropriate moment for drawing the whole world’s attention on the case. The UN’s report that accused Israel and Hamas for possible war crimes in the Gaza Strip in 2014, for several days was a topic of discussion and to provide a continuation, this was the most appropriate time for the PA to go to ICC and expect some results.
