The Initiative of Changing the Governance System in NKR in not Accidential

In those days the discussions on constitutional reforms in Nagorno-Karabakh Republic have activated. On July 30, the professional committee on constitutional reforms under NKR president introduced the concept of constitutional reforms to the President, which proposes to have a presidential model of governance.

It should be mentioned that currently NKR has semi-presidential model and the initiative to pass to a presidential one right now, is not accidential.

The April four-day war changed the situation, Despite the agreement on preserving the ceasefire regime, one should not exclude new escalation on the borders. Artsakh, which is a direct confluct side and for decades has been in "neither war, nor peace" situation needs more effective mechanisms for quick and effective response during wartime. This can be ensured by creating a corresponding governing system. The presidential model gives this opportunity. The international experience has proved that in countries, which are direct conflit sides, the most effective model is presidential. Thus it is the current situation, which makes go to such changes.

The same risks have also been considered during the constitutional amendments in the Republic of Armenia, but in this case another solution has been given. This refers to the issue of the usage of the armed forces.

Article 155, paragraph 1 of the Constitution states that "in cases of urgent necessity, the decision to use the armed forces, with the defense minister's recommendation, is being made by the Prime Minister, and shall immediately inform the members of the Government." This means that the issue will not be put for Parliament’s discussion and a possible quick mechanism for decision-making is set.

As for the previously voiced views that NKR tries to make its govenrnance system the same with the Republic of Armenia, then that thesis has already in fact been rejected. This once more shows that NKR as an independent country acts according to its needs and necessities.
