Malaysian Crushed Aircraft Case to Be Sent to UN

Exactly one year ago on July 17, Malaysian Boeing 777 aircraft was pierced in Donbass airspace, resulting in a death of 298 people, mostly Dutchmen, as the flight was planned from Amsterdam to Kuala Lumpur.

It is still not clear who was guilty of the crash. Separatists of Donbass are the first ones to be suspected, and not only Kiev blames them, but also most of the western world. Separatists, in turn, blame Ukrainians for the tragedy, and this time Moscow shares their view.

The two versions of the collision and the contradicting conclusions of the independent experts and specialists delay the final clarification of the crime and the punishment of those guilty. Thus, a group of countries, led by Malaysia decided to bring the case to the UN and the International Court of Justice to examine it, Bloomberg reports.

The tribunal would be "an effective guarantee for an independent and impartial accountability process," the draft resolution said. The text describes the downing of the plane as "a threat to international peace and security" and says that all states should cooperate fully with the tribunal.

Russia is strongly opposing this initiative and threatens to veto it in the UN Security Council. Russian President Vladimir Putin in a telephone conversation with the Dutch Prime Minister Mark Ryutei said that the UN court's idea was "premature and counterproductive," The Moscow Times reports. Mark Ryuten in turn told that the best option for such crimes of an international character are to be investigated in international courts, and that even if Russia does not agree to hand over the case to the United Nations, the Dutch had the second "back-up" plan to restore the justice and protect the interests of their fallen citizens and their families.

According to Pravda newspaper, besides Putin, Russia's permanent representative to the UN Vitaly Churkin also strongly opposed to the idea of establishing an international tribunal for the Malaysian Boeing, telling that one should wait for the results of the investigation before thinking of how to organize further trial.

National Security and Defense Council (NSDC) Secretary Oleksandr Turchynov said in an exclusive interview with Interfax-Ukraine that Russia tried to sabotage the investigation and deceive the public to cover its crimes.

"I'm sure that Russia, as the country that turned its soldiers into blood lusting terrorists, is completely responsible for the crime, and it must be the defendant at the tribunal. Russia has neither the moral nor legal right to block the decision on its creation," Turchynov said.

However, it will soon be clear whether the crished aircraft case will be eventually transferred to higher courts, that is to the most prestigious international court to be more exact, or it will rather get along with the local investigation results and the corresponding judgment.
